Introduction
Now Or Never FZC (referred to as "the Company", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal data when you use our website and services (the "Service"). The Company is based in Dubai, United Arab Emirates, and our data practices are in accordance with the laws of Dubai and the applicable federal laws of the UAE. By using the Service, you agree to the collection and use of information as described in this Privacy Policy.
Information We Collect
We collect various types of information from users of our Service:
  • Information You Provide: When you create an account or profile, or otherwise use the Service, you may provide personal information such as your name, username, email address, phone number, and profile photo. If you subscribe to or monetize content, you may provide payment information (e.g. credit card details or payout account details); note that payments are processed by our third-party payment provider and we do not store full financial account numbers. We also collect any content (including text, images, and other materials) you upload or post on the platform, as well as communications you send to us (such as support inquiries) or to other users via the Service.
  • Information from Your Use of the Service: When you use the Service, we automatically collect certain technical information. This includes your IP address, device and browser type, operating system, referring URLs, pages or content viewed, dates/times of access, and other usage details. We use cookies and similar tracking technologies to collect some of this information (see Cookies and Tracking below). For example, we may log when you last logged in, the features you used, and your interactions with content or other users on the platform.
  • Information from Third Parties: We may receive information about you from third-party sources. For example, if you choose to register or log in via a social media or external account (such as Google, Apple, or Instagram), we may receive basic profile information from that service (like your username or email associated with it). We may also receive transaction information from our payment processor (e.g. confirmation of subscription payments or payouts) and may utilize third-party verification services to confirm your identity or prevent fraud.
How We Use Your Information
We process personal data for the following purposes:
  • Providing and Improving the Service: We use your information to operate the platform, create and manage your account, allow you to create and view content, facilitate user interactions (e.g. enabling subscribers to view creators’ content), and process transactions (such as subscription payments and creator payouts). Your information helps us maintain the functionality and security of the Service, personalize your experience, and develop new features.
  • Communications: We use your contact information (e.g. email or phone number) to send you important account or transactional messages. These include confirmations of account actions, payment receipts, technical notices, security alerts (such as notices of unusual activity or policy changes), and support responses. We may also send you promotional communications about new features, content, or offers you might be interested in, but you will have the option to opt out of marketing emails or messages.
  • Enforcement and Safety: Your information helps us enforce our Terms of Use and other policies (for example, to detect and address violations like prohibited content). We may use data to prevent fraudulent transactions, unauthorized access, illegal activities, or misuse of the Service. For instance, we might use device and usage information to identify abuse or multiple accounts, or review content and messages for compliance with our rules. We also may use your information as necessary to protect the rights and safety of our Company, our users, or others (e.g. investigating reports of harassment or intellectual property infringement).
  • Legal Obligations: We may process your personal data to comply with applicable laws and regulations. For example, under UAE law we might retain transaction records for a certain period for tax or accounting purposes, or we may be required to respond to lawful requests by public authorities. If necessary, we will use your information to fulfill our legal duties, such as verifying age for consent requirements or blocking content that is illegal in our jurisdiction.
  • Legal Bases for Processing: When applicable data protection law (such as the UAE’s data protection law) requires a legal basis for processing personal data, we rely on several bases: (a) Contract – we process data to provide the Service as described in our agreement with you (the Terms of Use); (b) Legitimate Interests – we have legitimate interests in running a safe and effective service, improving our platform, and protecting our users and business (we only rely on this basis where those interests are not overridden by your privacy rights); (c) Consent – where we ask for your consent to process data for specific purposes (such as sending marketing communications or using certain cookies), and (d) Legal Compliance – processing necessary to comply with our legal obligations. Where we rely on your consent, you have the right to withdraw it at any time, which will not affect processing already occurred but will stop future processing based on that consent.
Cookies and Tracking Technologies
We use cookies and similar technologies to enhance your experience on our platform:
  • Cookies: A cookie is a small data file placed on your device. Our website uses both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device for a set period or until deleted) to remember your preferences, enable core functionalities, and collect usage data. For example, cookies allow us to keep you logged in as you navigate between pages, remember your language preferences, and track your engagement with content.
  • Analytics and Advertising: We may use third-party analytics tools (like Google Analytics or similar) that employ cookies or pixels to collect information about how users find and use our Service. This data helps us understand user behavior and improve the platform (for instance, identifying which features are popular or detecting potential user experience issues). We currently do not display third-party ads on the platform; if we do in the future, we will update this Policy and, if required, obtain your consent for any tracking across sites.
  • Your Choices: Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies or alert you when cookies are being sent. However, please note that if you disable or reject cookies, some features of the Service (such as keeping you logged in or remembering preferences) may not function properly. We also respect any legal requirements regarding cookie consent in the regions we operate. For more details on cookies and how we use them, please see our Cookies Policy (if we have a separate one) or contact us with any questions.
How We Share Your Information
We do not sell your personal information. We only share or disclose data as described below or with your consent:
  • With Service Providers: We share personal data with trusted third-party service providers who perform services on our behalf. These include our payment processor (Stripe), cloud hosting providers, database and storage providers, email and notification delivery services, analytics services, and customer support tools. These third parties process your information pursuant to contracts that require them to protect your data and use it only to provide the specific services or to assist us in operating the platform. For example, we share necessary personal and payment details with Stripe to process credit card transactions and facilitate payouts, and Stripe in turn has its own legal obligations to safeguard your data.
  • With Other Users: Some information is shared with other users by the nature of the platform. If you are a Content Creator, information such as your profile name, username, avatar/profile picture, and any biographical details or social media links you provide will be visible to all users. The content you post (e.g. photos, videos, posts) will be visible to users who have access to it (for example, subscribers who pay for your content, or all users if it’s posted freely). If you are a Fan/Subscribing User, creators you subscribe to may see your username, and any profile information you make public, as well as your interactions (for example, likes or comments on their posts). We do not disclose your payment information to other users. Use caution in what information you share publicly on your profile or in content, as it can be seen by others on the Service.
  • Business Transfers: If the Company is involved in a merger, acquisition, sale of assets, reorganization, or any other transaction involving a change of ownership, your personal data may be transferred to the successor or new owner as part of that deal. We will ensure that any such transfer is subject to your personal data being protected in a manner consistent with this Privacy Policy. We will notify you (for example, via email or a prominent notice on our site) of any change in ownership or uses of your personal data, as well as any choices you may have regarding your personal data in that event.
  • Legal Compliance and Protection: We may disclose your information if we determine that such disclosure is reasonably necessary to comply with applicable law, regulation, legal process, or governmental request. This can include responding to court orders, cooperating with regulators and law enforcement in the UAE or other jurisdictions, or pursuing legal remedies or limiting our damages in a legal proceeding. We may also share data in situations that involve potential threats to personal safety, unlawful activity, or violations of our Terms of Use — for instance, investigating reports of content that violates third-party rights or is otherwise illegal, and reporting information about that content (and the user responsible) to the appropriate authorities.
  • With Your Consent: Apart from the cases listed above, we will share your personal data with third parties only when you give us your explicit consent to do so. For example, if in the future we partner with another service to offer a joint feature, we would give you the choice to share your information with that service.
  • Aggregated or De-Identified Data: We may also share information that has been aggregated (grouped with other data so it does not directly identify you) or de-identified (stripped of personally identifying characteristics). For instance, we might publish trends about how many users are from different regions or what content categories are most popular, as long as this information does not identify any individual.
International Data Transfers
The Company is headquartered in the UAE, but our Service may be accessed by users around the world and involve global data flows. If you are using the Service from outside the United Arab Emirates, be aware that your personal data may be transferred to, stored in, or processed in the UAE and possibly other countries. We may utilize cloud servers or service providers located in the United States, Europe, or other jurisdictions. These countries may have data protection laws that are different from those in your country of residence. However, when we transfer personal data internationally, we take steps to ensure that appropriate safeguards are in place to protect your information in accordance with this Privacy Policy and applicable law. This may include using standard contract clauses approved by regulators, verifying that the recipient country has an adequate level of data protection according to UAE law, or other lawful mechanisms to legitimize the transfer. By using our Service or providing us with your information, you consent to the transfer of your personal data to other countries as described here. We will always protect your data as described in this Policy, wherever it is processed.
Data Security
We take data security seriously and implement reasonable and appropriate measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. Our security measures include administrative, technical, and physical safeguards. For example, we use encryption protocols for data transmitted between your device and our servers, restrict access to personal data to authorized personnel who need it for their job, and regularly review our information collection and storage practices. We also rely on reputable third-party service providers who are required to maintain appropriate security measures (for instance, Stripe is certified to PCI-DSS standards for handling payment information).
However, please note that no method of transmission over the internet, or method of electronic storage, is completely secure. While we strive to protect your personal data, we cannot guarantee its absolute security. You should also take steps to secure your account, such as choosing a strong password and keeping your login credentials confidential. If you suspect any unauthorized access to your account or information, notify us immediately so we can help investigate and take necessary measures.
Data Retention
We retain personal data for as long as reasonably necessary to fulfill the purposes for which it was collected, as outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. For example:
  • We will keep your account information and content while your account is active. If you delete your account, we will remove or anonymize your personal data within a reasonable time after account deletion (for instance, personal profile information and content may be deleted from our active databases within [X] days), except for information we are required to retain for legal obligations or legitimate business purposes.
  • Transaction records and payment information may be retained for the duration required by financial regulations and tax laws in Dubai/UAE (which could be several years) to comply with auditing requirements.
  • Communications with customer support might be retained to help us improve our Service and for future reference if you contact us again.
  • Data that has been aggregated or anonymized such that it can no longer be associated with you may be kept indefinitely for analytics or research purposes.
When we have no ongoing legitimate business need or legal requirement to process your personal data, we will delete it or anonymize it. If deletion is not immediately feasible (for example, because the data is stored in backup archives), we will securely store the data and isolate it from further processing until deletion is possible.
Your Rights and Choices
Under the laws of the UAE (as applicable in Dubai) and other applicable data protection laws, you may have certain rights regarding your personal data. These rights may include:
  • Access: You can request information about whether we hold personal data about you and, if so, request a copy of that information along with details about how we use it. This is sometimes called a “Data Subject Access Request.”
  • Correction: If any of your personal data is inaccurate or incomplete, you have the right to ask us to correct or update it. You can also update most basic account information by logging into your account settings.
  • Deletion: You can request that we delete your personal data. We will honor such requests whenever possible, but in some cases we may be required to retain certain information (e.g., to comply with legal obligations or to exercise or defend legal claims). If you request deletion, we will explain if any data must be retained and why.
  • Objection to Processing: You have the right to object to certain types of processing, such as processing for direct marketing or when we are processing based on a legitimate interest. If you object, we will evaluate whether we have any overriding legitimate grounds to continue processing (if permitted by law) and let you know our decision. Where we process personal data for marketing purposes, you can always object and we will stop using your data for those purposes.
  • Restriction of Processing: You can ask us to limit or “pause” the processing of your personal data in certain circumstances – for example, if you contest the accuracy of the data, or if you want to preserve data in connection with a legal claim but do not want us to otherwise use it.
  • Data Portability: To the extent applicable, you have the right to receive certain personal data you have provided to us in a structured, commonly used, machine-readable format, and to send it to another service (or have us transfer it for you, when technically feasible). This right applies when your data is processed by automated means and the processing is based on your consent or on a contract you have with us.
  • Withdraw Consent: If we rely on consent for a specific processing activity, you have the right to withdraw that consent at any time. For example, you can opt out of marketing emails by clicking the unsubscribe link, or withdraw consent for a specific optional feature by adjusting your settings. Note that withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.
To exercise any of these rights, please contact us using the information in the Contact Us section below. We may ask you to verify your identity (for example, by providing information only an account holder would know) before fulfilling your request. We will respond to your request within a reasonable timeframe as required by law. Please note that these rights are not absolute and may not apply in all situations or to all data; for instance, certain records may need to be kept for legal compliance. If you believe our processing of your personal data is not in line with applicable law, you also have the right to lodge a complaint with the relevant data protection authority in the UAE.
Children’s Privacy
Our Service is not directed to children under the age of 18. We do not knowingly collect personal information from anyone under 18 years old. If you are under 18, do not use the Service or provide any personal data to us. If we learn that we have inadvertently collected personal information from a child under 18, we will promptly delete such information from our records.
If you are a parent or guardian and become aware that a minor under your care has provided personal data to us without your consent, please contact us and we will take steps to remove the data and (if needed) terminate the child’s account.
While our platform is generally not restricted to adult users only (we do not publish an 18+ requirement, since the Service does not host explicit content), it is not targeted at minors. Certain features, such as content monetization (being a paid Creator) or making payments, is limited to users who are 18 years of age or older, in compliance with our policies and those of our payment processor.
Updates to this Privacy Policy
We may update or modify this Privacy Policy from time to time. If we make material changes to how we handle your personal data, we will notify you by appropriate means – for example, by posting a prominent notice on our website or sending an email notification. The “Last Updated” date at the top of this Policy reflects when the latest changes were made. We encourage you to review this Privacy Policy periodically to stay informed about our data practices. Your continued use of the Service after any changes to this Privacy Policy have been posted (and become effective) will constitute your acknowledgment of the changes and agreement to the updated policy.
